PART I: Terms of Service

1. Agreement to Terms

By purchasing, installing, or using IntelFortes ("the Platform"), you agree to be bound by these Terms of Service and the End User License Agreement below (collectively, "Terms"). These Terms constitute a legally binding agreement between you ("Licensee," "User") and mediaXtreme LLC ("Licensor," "we," "us"). If you do not agree to these Terms, do not purchase or use the Platform.

2. Eligibility

You must meet all of the following requirements to use IntelFortes:

  • You must be at least 18 years of age
  • You must use the Platform exclusively for legitimate security research, legal investigations, law enforcement operations, corporate threat intelligence, or academic cybersecurity research
  • You must have legal authority to conduct the type of research you intend to perform in your jurisdiction
  • You must not be located in a jurisdiction where the use of OSINT intelligence tools is prohibited by law
  • If purchasing on behalf of an organization, you represent that you have the authority to bind that organization to these Terms

3. No Warranty

IntelFortes is provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We explicitly disclaim all warranties regarding:

  • The accuracy, completeness, reliability, or timeliness of data sourced from the deep web, dark web, paste sites, breach archives, or any third-party source
  • Uninterrupted, error-free, or secure operation of the Platform
  • The availability or accuracy of any specific data set, record, or intelligence at any given time
  • Compatibility with your specific security research objectives or expected results
  • The correction of defects in the Platform within any specific timeframe

4. Ethical Use & Compliance

IntelFortes is designed and licensed exclusively for lawful, ethical purposes. You agree to comply with all applicable laws and regulations, including but not limited to:

  • GDPR (General Data Protection Regulation) -- if handling data of EU/EEA residents
  • CCPA (California Consumer Privacy Act) -- if handling data of California residents
  • CFAA (Computer Fraud and Abuse Act) -- you may not use IntelFortes to facilitate unauthorized access to computer systems
  • All applicable local, state, national, and international privacy, data protection, and cybersecurity laws

Acceptable uses include:

  • Authorized security research and penetration testing
  • Open-source intelligence (OSINT) investigations
  • Corporate threat intelligence and brand protection
  • Law enforcement investigations (with proper authorization)
  • Academic research in cybersecurity

5. Indemnification

You agree to indemnify, defend, and hold harmless mediaXtreme LLC, its officers, directors, employees, developers, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of or access to the Platform
  • Your violation of these Terms
  • Your violation of any applicable law, regulation, or third-party right
  • Any data you collect, process, store, or distribute using the Platform
  • Any claim by a third party related to your use of intelligence obtained through the Platform

6. Redaction Portal

IntelFortes maintains a Redaction Portal that allows data subjects to request the removal or masking of their personal data from IntelFortes indexes. We reserve the right to:

  • Remove, redact, or mask data in accordance with international privacy standards (GDPR, CCPA, and equivalent regulations)
  • Process "Right to Be Forgotten" requests and propagate redactions across all indexed instances
  • Temporarily or permanently restrict access to specific data sets if required by legal process or court order
  • Require operators of self-hosted instances to comply with redaction requests as a condition of continued licensing

7. No-Refund Policy

All sales of IntelFortes licenses, add-ons, and services are final and non-refundable. By completing your purchase, you acknowledge and agree to our No-Refund Policy.

8. Service & Subscriptions

Optional add-on services include:

  • Auto-Update Engine ($59/month) -- automatic delivery of new features, scraper updates, and security patches. Cancel anytime; your software continues on its current version.
  • Managed VPS Hosting ($45/month) -- fully configured server environment. Cancel with 30 days notice; data export assistance provided.
  • Professional Installation ($99 one-time) -- complete Docker stack deployment within 24 hours, including SSL, Elasticsearch tuning, and Tor configuration.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Texas.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms. Material changes will be communicated via email to registered license holders.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

PART II: End User License Agreement (EULA)

12. License Grant

Upon purchase, we grant you a non-exclusive, non-transferable, revocable license to use IntelFortes for internal security research and professional investigative purposes according to your purchased plan:

  • Analyst License ($299): Personal use on a single installation with up to 5 user accounts. Intended for individual researchers and security professionals conducting defensive research.
  • Enterprise License ($799): Agency/organization use on a single installation with unlimited user accounts. Includes dark web scrapers, API access, and white-label branding for professional intelligence operations.
  • Developer License ($2,497): Full source code access with resell rights. Permits unlimited installations, white-label rebranding, and redistribution of modified versions under separate Enterprise API agreements.

All licenses are perpetual for the version purchased. Access to future updates requires an active Auto-Update subscription. This license may be revoked immediately and without refund for any violation of these Terms.

13. Restrictions

You agree NOT to use IntelFortes for any of the following purposes:

  • Stalking, harassment, or illegal surveillance -- Using the Platform to track, monitor, or harass individuals without legal authority
  • Reselling raw data -- Redistributing, reselling, or commercially exploiting raw indexed data without a valid Enterprise API agreement from mediaXtreme LLC
  • Reverse engineering -- Decompiling, disassembling, or reverse-engineering IntelFortes binaries, or bypassing the IP-lock/hardware locking mechanism (except where explicitly permitted by the Developer License)
  • Automated searches without authorization -- Running automated, scripted, or bot-driven searches without API authorization from your license tier
  • Credential sharing -- Sharing your login credentials, license key, or API keys with unauthorized third parties
  • Identity theft, fraud, or criminal activity -- Using intelligence obtained through the Platform for any illegal purpose
  • Unauthorized access -- Using the Platform to facilitate unauthorized access to computer systems or networks

14. Data Origin & Intermediary Status

IntelFortes indexes data from third-party data breaches, dark web archives, paste sites, and public records. The Platform acts as a search intermediary only and does not:

  • Originate, create, or fabricate any data
  • Conduct the breaches or leaks from which indexed data originates
  • Guarantee the authenticity, accuracy, or completeness of any third-party data
  • Verify the identity of sources who originally published leaked data
  • Take responsibility for the legality of how original data was obtained by third parties

You acknowledge that all data within IntelFortes was sourced from publicly accessible archives and that mediaXtreme LLC bears no responsibility for the origin, accuracy, or legality of the underlying data.

15. Termination

mediaXtreme LLC reserves the right to immediately terminate your license and platform access without refund if:

  • You violate any provision of these Terms of Service or EULA
  • You use the Platform for illegal purposes, stalking, harassment, or unauthorized surveillance
  • You attempt to reverse-engineer, circumvent, or bypass licensing protections
  • You share credentials or redistribute the Platform without authorization
  • You file a chargeback or payment dispute without first contacting our support team
  • We receive a valid legal order requiring termination of your access

Upon termination, your license key will be permanently disabled, all API access revoked, and you must destroy all copies of the Software in your possession.

16. Limitation of Liability

To the maximum extent permitted by applicable law, mediaXtreme LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities arising from your use of the Platform
  • Damages resulting from actions taken based on intelligence obtained through IntelFortes
  • Third-party legal actions, claims, or proceedings arising from your use of data obtained through the Platform
  • Any damages related to the accuracy, completeness, or timeliness of indexed data
  • Service interruptions, data loss, or security breaches on your self-hosted instance

Our total aggregate liability shall not exceed the amount you paid for your license. You acknowledge that the Platform is a research tool and that all intelligence should be independently verified before any action is taken.
